In a groundbreaking shift for the cannabis industry, the U.S. Drug Enforcement Administration (DEA) has confirmed that cannabis seeds, tissue culture, and other genetic material are not necessarily controlled substances under the Controlled Substances Act (CSA). This clarification stems from the 2018 Farm Bill, which legalized hemp — defined as cannabis with less than 0.3% THC — and its derivatives.
Because cannabis seeds generally contain less than 0.3% THC, they now fall under the legal hemp category, regardless of the THC potential of the plants they grow into. This interpretation not only opens the door for seed sales across state lines but also fuels a new wave of research, breeding, and innovation in the cannabis and hemp sectors.
The legal landscape continues to evolve, but one thing is clear: the future of cannabis cultivation just got a lot more fertile.
